MUMBAI: A Supreme Court (SC) bench of justice Arun Mishra and justice Amitav Roy ordered the City and Industrial Development Corporation (CIDCO) on Monday to comply with an April order of the National Green Tribunal and pay a compensation of Rs10 crore within three weeks to the Raigad collector. This comes within a week of an SC order issuing a stay on the payment.
The collector will be distributing the amount among fishermen’s families in Uran and Panvel talukas of Raigad district who were displaced because of projects in the area.
Hearing an appeal where the appellant was the managing director of CIDCO and the MoEF secretary was the respondent, the SC judges stated, “The appellant is directed to deposit a sum of Rs10 crore before the authority concerned within three weeks.”
In March this year, a 73-page judgment by the western bench of the NGT had ordered CIDCO, the Jawaharlal Nehru Port Trust (JNPT) and the Oil and Natural Gas Corporation to pay Rs95.19 crore to 1,630 families within three months – JNPT coughing up 70% of the compensation amount – for a loss of three years.
In October 2013, a local fisherman Ramdas Koli moved the tribunal with regard to the impact of development projects by the public sector units on the tidal waters that have affected the livelihood of around 1,630 residents across four villages in Uran and Panvel talukas, and especially with JNPT’s proposed extension of the fourth berth in the area of its port that will result in the loss of a stock of fish.
“Until the SC releases the final judgment on all three agencies, I am not going to comment about the situation,” said Koli.
